- The Sweepstakes: Unique Beverage Company ("Unique"),
the maker of WIRED Energy Drink, is offering the "WIRED and Crackdownô
Sweepstakes" and will award not less than four hundred and one
(401) Grand Prizes and two thousand nine hundred and ninety nine (2,999)
First Prizes via a random selection of eligible entries.
This promotion begins on February 20, 2007 at 12:01 a.m. (U.S. Pacific
Time) and ends on December 20, 2007 at 11:59 p.m. (U.S. Pacific Time)
(the "Promotion Period") and is separated into three (3)
distinct segments. The first segment is a daily drawing that lasts
for twenty-nine (29) days (the "Unrelenting Giveaway"")
beginning on February 20, 2007 at 12:01 a.m. (U.S. Pacific Time) and
ending on March 20, 2007 at 11:59 p.m. (U.S. Pacific Time). The second
segment is a drawing every-other day that lasts for sixty (60) days
(the "Merciless Giveaway"") beginning on March
21, 2007 at 12:01 a.m. (U.S. Pacific Time) and ending on May 19, 2007
at 11:59 p.m. (U.S. Pacific Time). The third segment is a drawing
every month that lasts for seven (7) months (the "Pounding
Giveaway") beginning on May 20, 2007 at 12:01 a.m. (U.S.
Pacific Time) and ending on December 20, 2007 at 11:59 p.m. (U.S.
Pacific Time).
- To enter: To obtain one (1) entry, visit www.WiredCrackdown.com,
click on the sweepstakes registration link and complete the on-line
registration by providing the following information: First name, last
name, e-mail address, date of birth and home telephone number including
area code. Only on-line entrants who provide the required information
will be entered into the prize drawings. Each participant may enter
one (1) time per day during the Promotion Period.
- Prizes and Drawings: Four hundred and one (401) Grand Prizes
will be awarded: Official, original and unopened Crackdown™ games
for the Xbox 360™ console. Total approximate retail value of
each Grand Prize: $59.99. Two thousand nine hundred and ninety nine
(2,999) First Prizes will be awarded: Official WIRED and Crackdownô
t-shirts. Total approximate retail value of each First Prize: $12.00.
Total approximate retail value of all prizes to be awarded: $60,043.99.
Exact values are determined by the location and number of winners.
The odds of winning are determined by total number of eligible entries
received within the designated promotional period. All prizes will
be awarded. Limit of one prize per person, household, address and
e-mail address. Non-winning entries will not carry over to subsequent
drawings. In other words, after each drawing, if you are not selected
as a winner, you must re-register and submit an entry for the next
prize drawing.
During the Unrelenting Giveaway, at least four (4) Grand Prize
winners and twenty (20) First Prize winners will be selected from
eligible entries received each and every day for twenty-nine (29)
consecutive days. Individuals who did not win a prize during the preceding
prize drawings must re-register for each of the subsequent drawings
in order to be entered for a chance to receive a prize.
During the Merciless Giveaway, four (4) Grand Prize winners
and twenty (20) First Prize winners will be selected from eligible
entries received every-other day for sixty (60) consecutive days.
Individuals who did not win a prize during the preceding prize drawings
must re-register for each of the subsequent drawings in order to be
entered for a chance to receive a prize.
During the Pounding Giveaway, twenty-three (23) Grand Prize
winners and two hundred fifty seven (257) First Prize winners will
be selected from eligible entries received every month for seven (7)
consecutive months. Individuals who did not win a prize during the
preceding prize drawings must re-register for each of the subsequent
drawings in order to be entered for a chance to receive a prize.
Winners will be contacted via telephone, e-mail or mail within three
(3) business days after they have been selected. Prizes will be awarded
to each winner within seven (7) days after each winner provides the
Sponsor with the required eligibility verification information and
liability release.
- Eligibility: The sweepstakes is open to legal residents of
the fifty (50) United States (excluding New York and Florida) and
the District of Columbia, who are 17 years of age or older as of the
date of entry and who have access to the Internet. Employees, officers,
representatives and members of the immediate families of Sponsor,
Microsoft Corporation and affiliated companies, participating promotional
partners, advertising and promotion agencies, webmasters and any company
involved in the design, execution or production of the promotion are
not eligible. Void in U.S. territories, overseas protectorates, commonwealths
and military installations, and where prohibited by law.
- General: Potential winners will be determined via a random
selection from all eligible entries received. Prizes will be awarded
to the authorized account holder of the submitted Internet e-mail
address regardless of the individual who submitted the entry. The
authorized account holder is the person who is assigned to the e-mail
address by an Internet Service Provider or other organization that
is responsible for assigning e-mail addresses or the domain names
associated with e-mail addresses. Potential winners will be notified
by e-mail, telephone and/or mail within 3 days of the drawing date
and will be required to respond with prize acceptance information
to include proof of age, a complete and valid home address (not a
P.O. Box) and Affidavit of Eligibility and Liability/Publicity Release.
If the potential winner fails to respond within 5 days of first notification,
the prize is forfeited and an alternate winner will be randomly selected.
If any prize or prize notification is returned as undeliverable, the
prize will be forfeited and an alternate winner will be randomly selected.
- Liability Release: By entering the WIRED and Crackdownô Sweepstakes,
participants agree that Unique, Microsoft Corporation, their parent
and affiliated companies, employees, officers, directors, members,
shareholders, agents, and representatives of sponsor affiliates are
indemnified, released and will be held harmless by participants for,
from and against any and all liability, for any damages, injuries
or losses of any kind to person(s), including death, or property,
arising directly or indirectly from the acceptance, possession, misuse
or use of the prize. Winners will be required to sign a liability
release/waiver prior to fulfillment of any and all prizes. ANY AND
ALL TAX LIABILITY RESULTING FROM THE WINNER’S RECEIPT OF THE
PRIZE IS THE WINNER’S SOLE RESPONSIBILITY. There is no cash alternative.
Prizes are not transferable. In the event the winner cannot accept
the prize, an alternate winner will be randomly selected. Sponsor
reserves the right to substitute an item of equal or greater value.
By entering the sweepstakes, participants: (a) Agree to comply with
and be bound by the official rules and the decisions of Sponsor, which
are final and binding in all respects; (b) Agree to release Sponsor,
Microsoft Corporation and their employees, officers, directors, members,
shareholders, agents and representatives from any and all liability,
loss, damage or injury resulting from participation in this promotion
or from the awarding, receipt, possession use and/or misuse of the
prize; (c) Consent to the use by Sponsor of winner’s name, voice,
photograph and/or likeness for advertising and promotional purposes
in all media worldwide and in perpetuity without additional compensation,
unless prohibited by law; (d) Agree to complete and return to Sponsor
an Affidavit of Eligibility and Liability/Publicity Release prepared
by Sponsor within the timelines set forth in these Official Rules;
and (e) Agree to prepare and return to Sponsor IRS Form W-9, W-8BEN,
W-8ECI or other applicable tax forms, as appropriate and as requested
by Sponsor. Sponsor is not responsible for any lost, late, delayed,
misdirected, incorrect or inaccurate information or entries that are
misdirected or misrouted as a result of interrupted or unavailable
network connections or Internet transmissions for any reason, or any
failure of the website during the sweepstakes period, or for any computer,
telephone, telephone line hardware or software malfunction, failure
or error of any kind, whether mechanical, human or electronic. Any
attempt to deliberately damage any on-line service or website or to
undermine the legitimate operations of the sweepstakes is a violation
of criminal and civil laws. Should such an attempt be made, Sponsor
reserves the right to disqualify such entrant and to seek damages
from any such person to the fullest extent of the law. If, for any
reason, the sweepstakes is not capable of running as planned, including,
without limitation, infection by computer virus, bugs, tampering,
unauthorized intervention, fraud, technical failures, or any other
causes beyond Sponsor’s control which corrupt or affect the administration,
security, fairness, integrity or proper conduct of this sweepstakes,
Sponsor reserves the right at its sole discretion to cancel, terminate,
modify or suspend the sweepstakes and select winners in a random drawing
from among all eligible entries received prior to the cancellation.
All entries are the property of Sponsor.
- Disputes: Except where prohibited, entrant agrees that: (1)
any and all disputes, claims and cause of action arising out of or
connected with this Sweepstakes or any prize awarded shall be resolved
individually, without resort to any form of class action, and exclusively
by the United States District Court for the Western District of Washington
or the appropriate Washington State court located in Snohomish County,
Washington; (2) any and all claims, judgments and awards shall be
limited to actual out-of-pocket costs incurred, including costs associated
with entering this Sweepstakes, but in no event attorneys’ fees;
and (3) under no circumstances will entrant be permitted to obtain
awards for, and entrant hereby waives all right to claim, indirect,
punitive, exemplary, incidental and/or consequential damages and any
other damages, other than for actual out-of-pocket expenses, and any
and all rights to have damages multiplied or otherwise increased.
All issues and questions concerning the construction, validity, interpretation
and/or enforceability of these Official Rules, or the rights and obligations
of the entrant and Sponsor in connection with the Sweepstakes, shall
be governed by, and construed in accordance with, the laws of the
State of Washington, without giving effect to any choice of law or
conflict of law rules (whether of the State of Washington or any other
jurisdiction), which would cause the application of the laws of any
jurisdiction other than the State of Washington.
- Privacy: By entering the Sweepstakes, you agree to Sponsor’s
use of your personal information as described in Sponsor’s Privacy
Policy.
